Terms of Service

Welcome to Padelio! These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Acceptance of Terms

By creating an account or using Padelio, you confirm that:

• If you are a minor, you have parental or guardian consent to use the Services
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and up-to-date

2. Description of Services

Padelio provides a platform for organizing and participating in padel tournaments, including:

• Tournament creation and management
• Player registration and team formation
• Match scheduling and score tracking
• Automated standings and statistics
• Tournament discovery and join-by-code features

3. User Accounts and Registration

Account Creation

To use certain features, you must create an account using Telegram or Google authentication. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of unauthorized access

Account Deletion

You may delete your account at any time through the Account Settings page. Account deletion is permanent and cannot be undone. When you delete your account:

• Your personal information is permanently removed
• Your access to the Services is immediately terminated
• Your participation in tournaments is anonymized to preserve tournament history
• Tournaments you created remain accessible to other participants

Account Termination by Us

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. User Conduct and Responsibilities

You agree NOT to:

• Use the Services for any illegal purpose
• Harass, abuse, or harm other users
• Submit false or misleading information
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Use bots, scripts, or automated tools
• Reverse engineer or copy any part of the Services
• Share your account credentials with others

5. Tournament Participation

Registration and Commitment

When you join a tournament, you commit to:

• Participating in all scheduled matches
• Arriving on time to matches
• Reporting accurate scores
• Respecting other players and tournament organizers

Tournament Organizer Responsibilities

Tournament organizers are responsible for:

• Ensuring venue availability and court access
• Managing tournament logistics and disputes
• Collecting and handling entry fees (if applicable)

Padelio is a platform provider only. We are not responsible for tournament outcomes, disputes, or real-world logistics.

6. Subscriptions, Fees, and Payments

Padelio offers both free and paid subscription plans. Certain features are available only to users who subscribe to a paid plan ("Pro Organizer").

Free Plan

Padelio's core features are available for free, including creating up to 3 active tournaments, joining tournaments, and participating in leagues. Free plan limitations are described on our pricing page.

Paid Subscription Plans

Pro Organizer subscriptions are available on a monthly or yearly billing cycle. Current pricing is displayed on our pricing page and within the app before purchase. Prices may vary by region and currency and are determined by the applicable app store or payment platform.

Billing and Payment Processing

Payments are processed through third-party platforms depending on how you access the Service:

• iOS: Payments are processed by Apple through the App Store. Apple's terms and conditions apply to all purchases made through the App Store.
• Android: Payments are processed by Google through Google Play. Google Play's terms and conditions apply to all purchases made through Google Play.
• Web: Payments are processed by Stripe. Stripe's terms and conditions apply to all web-based purchases.
• Padelio does not directly collect, process, or store your credit card numbers or payment method details. All payment information is handled by the respective payment platform.

Auto-Renewal

All paid subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current billing period at the rate of your current plan. By subscribing, you authorize recurring charges on the same billing cycle until you cancel.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until your paid period expires. To cancel:

• iOS: Manage your subscription in Settings > Apple ID > Subscriptions on your device, or through the App Store.
• Android: Manage your subscription in Google Play Store > Payments & subscriptions > Subscriptions.
• Web: Manage your subscription through your Padelio account settings (Settings > Billing), which links to the Stripe customer portal.

Refunds

Refund requests for purchases made through the Apple App Store or Google Play Store are handled by Apple or Google respectively, in accordance with their refund policies. For web purchases made via Stripe, please contact us at legal@padelio.org within 14 days of purchase. We do not guarantee refunds and each request is reviewed on a case-by-case basis. Partial-period refunds are generally not provided.

Price Changes

We reserve the right to change subscription pricing. For existing subscribers, price changes will take effect at the start of the next billing period following at least 30 days' notice. If you do not agree with a price change, you may cancel your subscription before the new price takes effect. Continued use of the paid Service after a price change constitutes acceptance of the new pricing.

Feature Access After Expiration

If your subscription expires or is cancelled, you will revert to the free plan. You will retain access to your existing data but will be subject to free plan limitations (e.g., a maximum of 3 active tournaments). Leagues and seasons you created while subscribed will remain accessible to participants but you will not be able to create new ones until you resubscribe.

Free Trials

We may offer free trial periods for paid plans from time to time. If a free trial is offered, the specific terms will be presented to you before you start the trial. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate. You will only be eligible for one free trial per account.

Tournament Entry Fees

Tournament organizers may independently charge entry fees to participants. These fees are handled directly between the organizer and participants, outside of the Padelio platform. Padelio is not responsible for the collection, processing, or disputes related to tournament entry fees.

7. Intellectual Property Rights

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and software, are owned by Padelio or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without our express written permission.

8. User Content

You retain ownership of content you submit (profile information, tournament data, scores). By using our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content to provide and improve the Services.

We reserve the right to remove content that violates these Terms or is otherwise objectionable.

9. Privacy and Data Collection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the Services, you consent to our Privacy Policy. We collect anonymous usage analytics to improve the app experience; you can opt out of analytics data collection at any time through Privacy Settings in the app.

10. Disclaimers and Limitations of Liability

Service "As Is"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PADELIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

Not Responsible For

• Tournament disputes or cancellations
• Injuries occurring during matches
• Venue availability or conditions
• User disputes or conflicts
• Third-party authentication services

11. Indemnification

You agree to indemnify, defend, and hold harmless Padelio, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party

12. Termination

Voluntary Termination

You may terminate your account at any time by using the account deletion feature in Account Settings. Deletion is immediate and permanent. Please review our Privacy Policy for details on what data is deleted and what may be retained in anonymized form.

Termination by Padelio

We may terminate or suspend your account and access to the Services immediately, without prior notice, for any reason, including breach of these Terms.

Effects of Termination

Upon termination (whether voluntary or by us), your right to use the Services will cease immediately. We may retain certain anonymized information as required by law or for legitimate business purposes, such as maintaining tournament history for other participants.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the app or email. Continued use after changes constitutes acceptance of the modified Terms.

14. Dispute Resolution

Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Mandatory consumer protection laws of your country of residence remain applicable where required by law.

Arbitration

Any dispute arising from these Terms or the Services may be resolved through binding arbitration where legally permitted. Nothing in this section limits non-waivable consumer rights or mandatory rights to bring claims before competent courts under applicable law.

15. Miscellaneous

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Padelio.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of future enforcement.

Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
